1. Binding Agreement

These Terms and Conditions constitute a legally binding agreement between the participant and Osteopathic Medicine Limited (“NIS”, “we”, “us”, or “our”).

By submitting a registration form and/or completing payment, the participant agrees to be bound by these Terms in full.

Electronic acceptance, including acceptance via an online registration or payment platform, constitutes valid legal consent and forms a binding contract.

2. Business Structure and Independent Contractors

2.1 Osteopathic Medicine Limited operates under the trading name NIS Seminars.

2.2 Seminar presenters, educators, and facilitators may operate as independent contractors, not employees, partners, or agents of NIS.

2.3 Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship.

2.4 NIS is not responsible for personal opinions or statements made by presenters outside the scope of seminar delivery.

3. Registration and Payment

3.1 Full payment is required prior to seminar commencement.

3.2 All fees are payable in Australian Dollars (AUD) unless otherwise specified.

3.3 Accepted payment methods include:

  • Visa
  • Mastercard
  • American Express

3.4 The following are not accepted unless expressly approved:

  • Cash
  • Cheque
  • Instalments or split payments
  • Cryptocurrency
  • Payments on account

3.5 Registrations are not confirmed until cleared funds are received and eligibility requirements are satisfied.

3.6 NIS reserves the right to accept, decline, or revoke any registration at its sole discretion.

4. Prerequisite Requirement for NIS Advanced Seminar

4.1 Attendees of the NIS Advanced Seminar must have completed an NIS Foundation Seminar in the years of 2024, 2025, or 2026.

4.2 This NIS Foundation Seminar may be online or a physical seminar.

4.3 Participants may be required to provide evidence of prior completion of the NIS Foundation Seminar to the satisfaction of NIS.

4.4 Registering for this seminar without prior completion of the NIS Foundation Seminar may result in cancellation of registration at the sole discretion of NIS.

4.5 Where a registration is cancelled under this clause, any refund may be reduced by an administration fee of AUD $150 and any non-recoverable costs already incurred by NIS.

5. Course Content Acknowledgement

5.1 The participant acknowledges and agrees that NIS Advanced 2026 presents the same research content taught by Dr Allan Phillips at NIS Advanced 2025.

5.2 The participant acknowledges and agrees that no new research material will be introduced at NIS Advanced 2026 beyond what was presented at NIS Advanced 2025.

5.3 The participant acknowledges and agrees that practitioners seeking Dr Allan Phillips’ most current 2026 research should attend the NIS Research Symposium in Australia, Canada, or Germany.

5.4 The participant acknowledges and agrees that completion of NIS Advanced 2025 or 2026 is a prerequisite for Symposium attendance.

5.5 By registering for and/or paying for NIS Advanced Seminar – Melbourne, Australia, the participant confirms that they have read, understood, and accepted the course content description set out in this clause.

5.6 To the maximum extent permitted by law, the participant agrees that the fact that NIS Advanced 2026 presents the same research content as NIS Advanced 2025 does not, of itself, constitute grounds for cancellation, refund, chargeback, complaint, misrepresentation claim, or other dispute.

5.7 Nothing in this clause excludes, restricts, or modifies any rights that cannot lawfully be excluded, restricted, or modified, including under the Australian Consumer Law.

5.8 By registering for and/or paying for NIS Advanced Seminar – Melbourne, Australia, the participant confirms that they have read and understood that Dr Adrian Hubbard (Osteopath) will be presenting and teaching the course material over the 3-day seminar weekend, and that Dr Allan Phillips D.O. will not be the presenter or teacher of the course at this seminar.

Important Research Update: NIS Advanced 2026 presents the same research content taught by Dr Allan Phillips at NIS Advanced 2025. No new research material will be introduced at NIS Advanced 2026 beyond what was presented in 2025. Practitioners seeking Dr Phillips’ most current 2026 research should attend the NIS Research Symposium in Australia, Canada, or Germany. Completion of NIS Advanced 2025 or 2026 is a prerequisite for Symposium attendance.

6. Professional Eligibility Requirements

NIS provides professional education for qualified practitioners.

Participants must satisfy eligibility requirements.

A. Qualifications

Applicants should hold a post-graduate qualification or equivalent acceptable to NIS, including but not limited to:

  • Medical Doctors / Specialists
  • Osteopaths
  • Chiropractors
  • Physiotherapists
  • Nurses
  • Acupuncturists
  • Naturopaths
  • Dentists
  • TCM Practitioners
  • Veterinarians
  • Occupational Therapists
  • Other approved practitioners

B. Licensing

Where applicable, participants must hold current registration permitting independent practice.

6.1 NIS may request verification at any time.

6.2 Registrations may be declined or revoked at NIS’s discretion.

6.3 False declarations may result in cancellation and refund less an administration fee and incurred costs.

7. Student and Refresher Registrations

7.1 Student registrations require proof of enrolment.

7.2 Refresher rates apply only where explicitly approved.

7.3 False claims may result in cancellation and adjusted refund.

7.4 No entitlement to discounted rates unless approved by NIS.

8. Educational Disclaimer

8.1 All content is provided for educational purposes only.

8.2 To the maximum extent permitted by law:

  • No clinical, medical, financial, or professional outcomes are guaranteed
  • Attendance does not confer certification or licensure
  • Results vary by individual

8.3 NIS does not provide medical advice.

8.4 Content may be delivered by independent contractors whose views do not necessarily represent NIS.

9. Seminar Inclusions and Exclusions

Included:

  • 3-day seminar
  • Teaching materials (as provided)
  • Morning and afternoon tea & coffee
  • Buffet lunch

Excluded:

  • Travel
  • Accommodation
  • Insurance
  • Personal expenses
  • Loss of income
  • External costs

NIS may vary presenters, venue, or schedule where necessary.

10. Cancellation, Postponement or Changes by NIS

10.1 NIS may cancel, reschedule, relocate, or modify the seminar where reasonably required.

10.2 This includes events beyond control such as:

  • Natural disasters
  • Government restrictions
  • Venue issues
  • Illness
  • Transport disruption

10.3 If NIS cancels and does not reschedule, a refund of seminar fees will be provided.

10.4 NIS is not responsible for external costs (travel, accommodation, etc.).

11. Participant Cancellation Policy

11.1 Written Notice Required
All cancellations must be submitted in writing to NIS Seminars.

11.2 Cancellation Fees
Subject to clause 19 (Australian Consumer Law) and any non-excludable rights:

  • 30 days or more prior: refund less AUD $150 administration fee
  • 3 to 29 days prior: 50% of seminar fee may be retained
  • Less than 48 hours prior or non-attendance: no refund

11.3 Commercial Basis
Participants acknowledge that cancellation fees represent a genuine pre-estimate of costs and losses incurred by NIS.

11.4 Discretion
NIS may, at its sole discretion, offer a transfer, credit, or alternative placement instead of a refund.

11.5 No Refund for Removal
Participants removed for breach of these Terms are not entitled to a refund.

11.6 Australian Consumer Law
Nothing in this clause excludes or restricts rights under Australian Consumer Law.

12. Chargebacks and Payment Disputes

Participants agree to contact NIS first before initiating a chargeback.

Improper chargebacks may constitute breach of contract.

NIS reserves the right to recover associated costs where permitted by law.

13. Conduct and Right to Refuse Service

13.1 Participants must behave professionally and respectfully.

13.2 NIS may remove any participant without refund for:

  • Disruptive or unsafe behaviour
  • Harassment or misconduct
  • Non-compliance with directions

13.3 Registrations are non-transferable unless approved.

14. Assumption of Risk

Participants attend at their own risk and are responsible for their own health, safety, and belongings.

15. Limitation of Liability

To the maximum extent permitted by law:

  • NIS is not liable for indirect or consequential loss
  • Total liability is limited to the seminar fee paid
  • NIS is not liable for third-party providers

Nothing excludes rights that cannot legally be excluded.

16. Intellectual Property

All seminar content remains the property of NIS.

Participants may not copy, record, distribute, or reproduce content without written consent.

17. Media Release

Participants consent to photography and recording unless they notify NIS in writing before the seminar.

Participants may not record seminar content without permission.

18. Privacy

Participants consent to the collection and use of personal information for seminar administration and related purposes.

19. Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any rights under the Australian Consumer Law.

20. Governing Law

These Terms are governed by the laws of Victoria, Australia.

21. Entire Agreement and Severability

These Terms constitute the entire agreement.

If any provision is invalid, the remainder remains enforceable.

22. Acceptance

Submission of registration and/or payment constitutes full acceptance of these Terms and forms a legally binding agreement.
