NIS Advanced Online Seminar Course - Australasia Terms & Conditions

Effective Date: [March 1st, 2026]

By purchasing and/or accessing this online seminar (“Seminar”), you (“Attendee”) agree to be legally bound by these Terms & Conditions.

1. Eligibility & Practitioner Requirement

This Seminar is strictly restricted to qualified healthcare practitioners who have completed the NIS Foundation prerequisite course either online or attended the NIS Foundation course in person.

By purchasing, you confirm that you:

  • Are a citizen or legal resident of Australia or New Zealand; and

  • Are currently practising as a healthcare professional within a clinic, private practice, hospital, or registered healthcare setting in Australia or New Zealand.

  • Have attended an NIS Foundation seminar and/or purchased NIS Foundation seminar online.

Neurolink Seminars reserves the right to:

  • Request proof of qualifications, registration, or practice location

  • Refuse or revoke access if eligibility criteria are not met

2. Geographic Restriction

This Seminar is licensed exclusively for use within Australia and New Zealand.

Access or use outside these jurisdictions is strictly prohibited without prior written consent from Neurolink Seminars.

3. Personal Licence & Use Restrictions

Purchase grants a non-transferable, non-exclusive, revocable licence for personal professional use only.

Access is strictly limited to:

  • The individual named on the Stripe payment record (first and last name)

The following are strictly prohibited:

  • Sharing login credentials or access

  • Distributing, copying, reproducing, or recording any Seminar content

  • Screen recording, photographing, or duplicating materials

  • Selling, sublicensing, or commercially exploiting content

  • Teaching, presenting, or re-delivering Seminar content to third parties

All Seminar materials are the intellectual property of Neurolink Seminars and/or Dr Allan Phillips and are protected by copyright law.

Any use outside these Terms requires prior written consent from Dr Allan Phillips, Director & CEO.

4. Currency & Payment

All Seminar prices are displayed and charged in Australian Dollars (AUD).

By completing payment, the Attendee:

  • Irrevocably agrees to the price in AUD

  • Acknowledges that no representation has been made that pricing is in NZD or any other currency

  • Accepts full responsibility for any currency conversion fees, exchange rate differences, or bank charges

No refunds or disputes will be accepted on the basis of currency misunderstanding.

5. No Refund Policy

Due to the digital nature of the Seminar, all purchases are:

  • Final

  • Non-refundable

  • Non-transferable

No refunds will be provided for:

  • Change of mind

  • Failure to meet eligibility requirements

  • Inability to attend or complete the Seminar

  • Currency-related misunderstandings

6. Intellectual Property & Copyright

All Seminar content, including but not limited to:

  • Video recordings

  • Slides

  • Documents

  • Clinical frameworks

  • Methodologies

is protected under Australian and international copyright laws.

Unauthorised use constitutes copyright infringement.

7. Breach, Damages & Financial Liability

The Attendee acknowledges that any breach of these Terms, including but not limited to:

  • Unauthorised sharing, distribution, or access

  • Use by non-eligible individuals

  • Access outside permitted jurisdictions

  • Reproduction, recording, or commercial use of content

constitutes a serious breach of intellectual property rights and causes significant commercial harm to Neurolink Seminars.

In the event of a breach, the Attendee agrees that Neurolink Seminars is entitled to recover, at its sole discretion:

  • Liquidated damages of not less than AUD $10,000 per breach, or

  • The full commercial value of the loss, misuse, or unauthorised distribution, whichever is greater

The Attendee further agrees to indemnify Neurolink Seminars against all losses, including:

  • Legal costs (on a full indemnity basis)

  • Investigation and enforcement costs

  • Any third-party claims arising from the breach

Neurolink Seminars reserves the right to:

  • Immediately terminate access without refund

  • Suspend or restrict access

  • Pursue legal action

  • Seek injunctive relief to prevent further breaches

8. Chargebacks & Payment Disputes

Any chargeback or payment dispute initiated on the basis of:

  • Currency misunderstanding

  • Failure to read or understand these Terms

  • Change of mind

will constitute a material breach of this Agreement.

Neurolink Seminars reserves the right to recover:

  • The original purchase amount

  • An administration fee of AUD $250 per dispute

  • All associated costs, including merchant fees, legal costs, and debt recovery expenses

9. Access & Availability

Access to the Seminar is provided as a digital service.

Neurolink Seminars does not guarantee uninterrupted or error-free access and is not liable for:

  • Internet connectivity issues

  • Platform downtime

  • Technical disruptions outside its control

Neurolink Seminars reserves the right to:

  • Modify or update content

  • Restrict access where Terms are breached

10. Clinical Disclaimer

This Seminar is provided for educational purposes only and does not constitute medical advice.

All clinical decisions, applications, and patient outcomes remain the sole responsibility of the Attendee.

11. Limitation of Liability

To the maximum extent permitted by law, Neurolink Seminars shall not be liable for:

  • Any indirect, incidental, or consequential damages

  • Loss of income, business, or reputation

Total liability is limited to the amount paid for the Seminar.

12. Governing Law

These Terms are governed by the laws of New South Wales, Australia.

Where the Attendee is located in New Zealand, nothing in these Terms excludes any rights or remedies that may apply under applicable New Zealand consumer law.

To the maximum extent permitted by law, the parties submit to the jurisdiction of the courts of New South Wales, Australia.

13. Monitoring & Enforcement

Neurolink Seminars reserves the right to monitor access and usage, including:

  • IP address tracking

  • Login activity

  • Access patterns

to detect unauthorised use or breaches of these Terms.

14. Entire Agreement & Acceptance

By completing your purchase, you confirm that:

  • You meet the eligibility requirements

  • You understand this Seminar is priced in AUD

  • You agree not to share or distribute any content

  • You accept these Terms & Conditions in full

These Terms constitute the entire agreement between the parties.
