NIS Research Symposium – Terms and Conditions
Terms applicable to the NIS Research Symposium – Melbourne, Australia.
Attendance at this Symposium requires prior completion of NIS Advanced 2025 or NIS Advanced 2026, either physical or online, as set out below. This requirement is mandatory, essential, non-negotiable, and strictly enforced. Registrations that do not meet this prerequisite may be cancelled.
1. Binding Agreement
These Terms and Conditions constitute a legally binding agreement between the participant and Osteopathic Medicine Limited (“NIS”, “we”, “us”, or “our”).
By submitting a registration form and/or completing payment, the participant agrees to be bound by these Terms in full.
Electronic acceptance, including acceptance via an online registration or payment platform, constitutes valid legal consent and forms a binding contract.
2. Business Structure and Independent Contractors
2.1 Osteopathic Medicine Limited operates under the trading name NIS Seminars.
2.2 Seminar presenters, educators, and facilitators may operate as independent contractors, not employees, partners, or agents of NIS.
2.3 Nothing in these Terms creates any partnership, joint venture, agency, or employment relationship.
2.4 NIS is not responsible for personal opinions or statements made by presenters outside the scope of seminar delivery.
3. Registration and Payment
3.1 Full payment is required prior to seminar commencement.
3.2 All fees are payable in Australian Dollars (AUD) unless otherwise specified.
3.3 Accepted payment methods include:
- Visa
- Mastercard
- American Express
3.4 The following are not accepted unless expressly approved:
- Cash
- Cheque
- Instalments or split payments
- Cryptocurrency
- Payments on account
3.5 Registrations are not confirmed until cleared funds are received and eligibility requirements are satisfied.
3.6 NIS reserves the right to accept, decline, or revoke any registration at its sole discretion.
4. Prerequisite Requirement for NIS Research Symposium
4.1 Mandatory Prerequisite Requirement
Attendance at the NIS Research Symposium requires prior completion of NIS Advanced 2025 and/or NIS Advanced 2026.
Completion may include:
- NIS Advanced 2025 completed as a physical seminar in Australia, Canada, or Germany;
- NIS Advanced 2025 completed online;
- NIS Advanced 2026 completed as a physical seminar in Australia or the USA;
- NIS Advanced 2026 completed online.
These prerequisite requirements are essential, mandatory, non-negotiable, and must be satisfied before attendance at the Symposium.
4.2 Enforcement
Participants who do not meet the prerequisite requirements are not eligible to attend the NIS Research Symposium.
4.3 Verification
NIS may require proof of completion of NIS Advanced 2025 or NIS Advanced 2026 at any time before or during the Symposium.
4.4 Cancellation
Registering for this Symposium without satisfying the prerequisite requirements may result in cancellation of registration at the sole discretion of NIS.
4.5 Refund Adjustment
Where a registration is cancelled under this clause, any refund may be reduced by an administration fee of AUD $150 and any non-recoverable costs already incurred by NIS.
4.6 Australian Consumer Law
Nothing in this clause excludes, restricts, or modifies any rights that cannot lawfully be excluded, restricted, or modified, including under the Australian Consumer Law.
5. Professional Eligibility Requirements
NIS provides professional education for qualified practitioners.
Participants must satisfy eligibility requirements.
A. Qualifications
Applicants should hold a post-graduate qualification or equivalent acceptable to NIS, including but not limited to:
- Medical Doctors / Specialists
- Osteopaths
- Chiropractors
- Physiotherapists
- Nurses
- Acupuncturists
- Naturopaths
- Dentists
- TCM Practitioners
- Veterinarians
- Occupational Therapists
- Other approved practitioners
B. Licensing
Where applicable, participants must hold current registration permitting independent practice.
5.1 NIS may request verification at any time.
5.2 Registrations may be declined or revoked at NIS’s discretion.
5.3 False declarations may result in cancellation and refund less an administration fee and incurred costs.
6. Student and Refresher Registrations
6.1 Student registrations require proof of enrolment.
6.2 Refresher rates apply only where explicitly approved.
6.3 False claims may result in cancellation and adjusted refund.
6.4 No entitlement to discounted rates unless approved by NIS.
7. Educational Disclaimer
7.1 All content is provided for educational purposes only.
7.2 To the maximum extent permitted by law:
- No clinical, medical, financial, or professional outcomes are guaranteed
- Attendance does not confer certification or licensure
- Results vary by individual
7.3 NIS does not provide medical advice.
7.4 Content may be delivered by independent contractors whose views do not necessarily represent NIS.
8. Seminar Inclusions and Exclusions
Included:
- 2-day Symposium
- Teaching materials, as provided
- Morning and afternoon tea & coffee, where provided by NIS
- Buffet lunch, where provided by NIS
Excluded:
- Travel
- Accommodation
- Insurance
- Personal expenses
- Loss of income
- External costs
NIS may vary presenters, venue, content order, format, or schedule where reasonably necessary.
9. Cancellation, Postponement or Changes by NIS
9.1 NIS may cancel, reschedule, relocate, or modify the Symposium where reasonably required.
9.2 This includes events beyond control such as:
- Natural disasters
- Government restrictions
- Venue issues
- Illness
- Transport disruption
9.3 If NIS cancels and does not reschedule, a refund of Symposium fees will be provided.
9.4 NIS is not responsible for external costs, including travel, accommodation, insurance, personal expenses, or loss of income.
10. Participant Cancellation Policy
10.1 Written Notice Required
All cancellations must be submitted in writing to NIS Seminars.
10.2 Cancellation Fees
Subject to clause 18 (Australian Consumer Law) and any non-excludable rights:
- 30 days or more prior: refund less AUD $150 administration fee
- 3 to 29 days prior: 50% of Symposium fee may be retained
- Less than 48 hours prior or non-attendance: no refund
10.3 Commercial Basis
Participants acknowledge that cancellation fees represent a genuine pre-estimate of costs and losses incurred by NIS, including administration, venue commitments, staffing, materials, and lost capacity.
10.4 Discretion
NIS may, at its sole discretion, offer a transfer, credit, or alternative placement instead of a refund.
10.5 No Refund for Removal
Participants removed for breach of these Terms are not entitled to a refund.
10.6 Australian Consumer Law
Nothing in this clause excludes or restricts rights under Australian Consumer Law.
11. Chargebacks and Payment Disputes
Participants agree to contact NIS first before initiating a chargeback or payment dispute.
Improper chargebacks may constitute breach of contract.
NIS reserves the right to recover associated costs where permitted by law.
12. Conduct and Right to Refuse Service
12.1 Participants must behave professionally and respectfully.
12.2 NIS may remove any participant without refund for:
- Disruptive or unsafe behaviour
- Harassment or misconduct
- Non-compliance with directions
- Breach of these Terms
12.3 Registrations are non-transferable unless approved by NIS in writing.
13. Assumption of Risk
Participants attend at their own risk and are responsible for their own health, safety, belongings, travel arrangements, and insurance.
14. Limitation of Liability
To the maximum extent permitted by law:
- NIS is not liable for indirect or consequential loss
- Total liability is limited to the Symposium fee paid
- NIS is not liable for third-party providers
Nothing excludes rights that cannot legally be excluded.
15. Intellectual Property
All Symposium content remains the property of NIS or its licensors.
Participants may not copy, record, distribute, reproduce, publish, teach, resell, or adapt content without prior written consent.
16. Media Release
Participants consent to photography and recording unless they notify NIS in writing before the Symposium.
Participants may not record Symposium content without permission.
17. Privacy
Participants consent to the collection and use of personal information for Symposium administration, eligibility verification, communication, and related purposes.
18. Australian Consumer Law
Nothing in these Terms excludes, restricts, or modifies any rights under the Australian Consumer Law or any other rights that cannot lawfully be excluded, restricted, or modified.
19. Governing Law
These Terms are governed by the laws of Victoria, Australia.
20. Entire Agreement and Severability
These Terms constitute the entire agreement between NIS and the participant regarding the Symposium.
If any provision is invalid or unenforceable, the remainder remains enforceable.
21. Acceptance
Submission of registration and/or payment constitutes full acceptance of these Terms and forms a legally binding agreement.
