Terms of Service: NIS Academy Membership

1. Agreement to Terms
By subscribing to the NIS Academy Membership, you agree to these Terms of Service (“Terms”), our Privacy Policy, and any additional terms provided at sign-up. These Terms apply to users in Australia, New Zealand, USA, Canada, and Europe. If you do not agree to these Terms, you may not use the service.
1.1 Eligiblility for NIS Academy membership
NIS Academy membership is only available to the following members:
Members who have completed NIS Foundation in the prior 3 years and are registering for NIS Masters or NIS Advanced this year and who have successfully completed the NIS proficiency assessment.
. Members who have attended NIS Masters or NIS Advanced in the prior 3 year
Failure to meet the above eligibility criteria will result in the non-refundable cancellation of the NIS Academy membership.
2. Recurring Payment Authorization
2.1 Subscription and Billing Cycle
The NIS Academy Membership renews automatically on a monthly basis, charging the payment method provided at registration.
2.2 Payment Processing
Payments are securely processed via Stripe. By subscribing, you authorize Stripe to charge your payment method on our behalf. We are not liable for payment processing errors caused by Stripe.
2.3 Non-Refundable Payments
Payments for the NIS Academy Membership are non-refundable, including for partial months, unused services, or subscription downgrades.
Exceptions for Europe Only:
Under EU consumer protection laws, you may have a 14-day cooling-off period after the initial subscription, during which you can cancel and request a refund for unused services.
2.4 Price Adjustments
We reserve the right to modify subscription fees with 15 days’ notice. Your continued use of the service after the change constitutes acceptance of the new pricing.
3. Subscription Cancellation
3.1 Cancellation Policy
You may cancel your NIS Academy Membership at any time through your account dashboard or by contacting our support team. Cancellations must be made at least 5 business days before your next billing date to avoid charges for the next cycle.
3.2 No Proration
Cancellations apply only to future billing cycles. We do not provide refunds or prorated credits for unused portions of the current billing cycle.
3.3 Provider’s Right to Cancel
We reserve the right to terminate your subscription for any reason, including violation of these Terms, with or without notice. Refunds for such cancellations are at our sole discretion.
4. Service Availability
We strive to provide uninterrupted access to the NIS Academy Membership but cannot guarantee availability. Service disruptions due to maintenance, technical issues, or force majeure events do not qualify for refunds.
Australia & New Zealand:
Consumer guarantees under the Australian Consumer Law (ACL) and the New Zealand Consumer Guarantees Act (CGA) apply to services not provided with due care and skill.
5. Limitation of Liability
To the fullest extent permitted by law:
• We are not liable for indirect or consequential damages related to the use of the NIS Academy Membership.
• Our maximum liability is limited to the total subscription fees paid by you in the preceding three months.
Consumer Rights in Australia, New Zealand, and Europe:
This clause does not exclude rights under applicable consumer laws, including guarantees of acceptable quality and service under the ACL, CGA, or EU laws.
6. Dispute Resolution
6.1 Governing Law
Disputes are governed by the laws of the user’s region:
• Australia and New Zealand: Governed by the laws of Australia or New Zealand, respectively.
• USA and Canada: Governed by the laws of the state or province of residence.
• Europe: Governed by the laws of the country of residence under applicable EU regulations.
6.2 Binding Arbitration (USA and Canada Only)
For users in the USA and Canada, disputes will be resolved through binding arbitration, and you waive the right to participate in class actions.
7. Changes to Terms
We may update these Terms at any time, with changes taking effect upon posting. Continued use of the NIS Academy Membership after changes are posted constitutes acceptance.
